The BSR has extensive enforcement powers under the Building Safety Act. Understanding these powers — and the consequences of non-compliance — is critical.. The BSR's Arsenal The Building Safety Regulator (BSR), operating within the Health and Safety Executive (HSE), has been granted unprecedented enforcement powers under the Building Safety Act 2022. Compliance Notices The BSR can issue a compliance notice requiring the Accountable Person to: Take specified steps to remedy a contravention Take specified steps to prevent a contravention recurring Comply within a specified timescale Non compliance is a criminal offence — unlimited fine and/or imprisonment. Improvement Plans Where systemic failures are identified, the BSR can require an improvement plan: Specify the improvements needed Set timescales for each improvement Require regular progress reporting Escalate to enforcement action if plan not followed Special Measures In serious cases, the BSR can take a building into special measures: Appoint a Special Measures Manager to take over building safety management Remove the Accountable Person from their role The building owner/leaseholders bear the costs of special measures Extreme measure — reserved for the most serious failures Stop Notices During construction of HRBs, the BSR can issue stop notices: Immediately halt construction work Require remediation before work can resume Prosecution for failure to comply Significant financial impact — project delays of weeks or months Criminal Prosecution The BSA 2022 creates several criminal offences: Failure to register an HRB Failure to prepare a Safety Case Report Failure to report a Mandatory Occurrence Providing false or misleading information to the BSR Failure to comply with compliance notices Obstructing the BSR in the exercise of its functions Penalty Framework Offence Maximum Penalty Summary conviction Unlimited fine Conviction on indictment Unlimited fine + 2 years imprisonment Corporate liability Unlimited fine + remedial order Director liability Personal prosecution where consent/connivance/neglect shown For BSR compliance guidance, contact us.
