The UK's post-Brexit construction products regime is evolving. Understanding fire testing requirements, CE/UKCA marking, and the new Construction Products Regulator.. The Changing Landscape The UK's departure from the EU has created a transitional period for construction product regulation. Fire safety products are at the centre of this transformation. Current Position CE marking: Still accepted in Great Britain until further notice Harmonised European standards (hENs) continue to apply Products tested to EN 13501 1 for reaction to fire Products tested to EN 13501 2 for fire resistance UKCA marking: UK Conformity Assessed marking — the UK replacement for CE Currently voluntary for most construction products UKCA requires testing by UK approved bodies Transition period extended multiple times EN 13501 Classification System Reaction to fire (EN 13501 1): Class Description A1 Non combustible — no contribution to fire A2 Limited combustibility — very limited contribution B Very limited contribution to fire C Limited contribution to fire D Acceptable contribution to fire E Acceptable behaviour in fire F No performance determined Additional classifications: s1, s2, s3 — smoke production (s1 lowest) d0, d1, d2 — flaming droplets/particles (d0 none) Example: A2 s1,d0 — limited combustibility, low smoke, no droplets (required above 18m) The New Construction Products Regulator The Building Safety Act 2022 creates a new Construction Products Regulator with powers to: Remove unsafe products from the market Prosecute manufacturers who make misleading claims Require product recalls Share information with trading standards and fire services Establish a national incident reporting system for construction product failures What This Means for the Industry 1. Increased scrutiny of fire test evidence for all construction products 2. End of 'desktop studies' as substitute for physical fire testing 3. Third party certification becoming the market expectation 4. Accountability for product performance claims 5. Potential criminal liability for manufacturers making false fire safety claims For construction product fire testing guidance, contact us.
